Congress Advances Legislation to Streamline AAM Certification Timelines
Congress is progressing with legislation designed to enhance the predictability of the Federal Aviation Administration’s (FAA) certification process for advanced air mobility (AAM) aircraft, including electric vertical takeoff and landing vehicles (eVTOLs). The Aviation Innovation and Global Competitiveness Act, which was advanced by the Senate Commerce Committee on July 22, mandates that the FAA publish a comprehensive certification plan and establish expected timeframes for critical stages of the review process. A companion bill has also been introduced in the House of Representatives.
Proposed Certification Framework and Industry Implications
The legislation requires the FAA to develop and release a certification plan for AAM aircraft within 180 days of enactment. This plan is expected to address the agency’s issue-paper process, recurring certification questions, and performance-based standards, while clarifying when industry consensus standards may be applied for compliance. Furthermore, within 270 days, the FAA must set nonbinding expected time ranges for key milestones such as issue papers, special conditions, exemption requests, and proposed means of compliance.
Senator Ted Budd (R-N.C.) emphasized the importance of prioritizing certification for novel aircraft, stating, “By ensuring that the FAA prioritizes the certification of novel aircraft like eVTOLs, we can quickly incorporate innovative technology into the National Airspace System.”
Despite this momentum, challenges remain. Concerns have been raised about potential disparities in certification, infrastructure deployment, and commercialization timelines across different jurisdictions, which could affect market readiness. The industry is responding with heightened scrutiny and pressure on the FAA to accelerate its processes. At the same time, competitors may recalibrate their strategies to align with evolving regulatory expectations, potentially altering market leadership and influencing investment flows. The successful commercial deployment of AAM will depend not only on regulatory clarity but also on the timely development of the necessary energy and infrastructure ecosystems to support scalable operations.
Safety, Transparency, and Stakeholder Engagement
The bill incorporates provisions to maintain safety and transparency throughout the certification process. The FAA administrator would retain discretion to exclude complex matters from the established timelines, and the specified time ranges would not confer new legal rights or permit applicants to seek judicial review if deadlines are missed. Senator Peter Welch (D-Vt.) highlighted the significance of these measures, noting, “Ensuring the FAA certification process is safe, efficient, and more transparent for emerging AAM companies like Beta is critical to promoting aviation innovation.”
An amendment adopted by the Senate Commerce Committee further requires the FAA to consult with aviation safety inspectors, technicians, engineers, and the principal organization representing airline pilots. The legislation also calls for updated guidance to delineate which certification findings may be delegated to authorized representatives and which decisions must remain under FAA authority.
As Congress moves forward with this legislation, the interaction between regulatory timelines, industry adaptation, and infrastructure readiness will play a pivotal role in shaping the future landscape of advanced air mobility in the United States.
